Employment disputes

Employment disputes may arise for many reasons. In most times, they can be resolved by reviewing the governing law and dispute resolution clause which would stipulate the appropriate jurisdiction and forum to settle the dispute. Mediation is often encouraged to resolve the dispute as the first step and the Tripartite Alliance for Dispute Management (TADM) provides employees and employers with services to resolve salary-related claims and employment disputes. Claims resolved through mediation are settled when parties sign a settlement agreement under the Employment Claims Act 2016.

Claims that cannot be resolved through mediation will be issued a claim referral certificate and referred to the Employment Claims Tribunal (ECT). Generally, the ECT hears the following types of claims:

Managers interviewing a job applicant

For employees

  • Statutory salary-related claims
  • Contractual salary-related claims
  • Wrongful dismissal claims

For employers

Claims for salary in lieu of notice for all employers

Depending on your claim and the circumstances, you may be able to claim up to $20,000 or up to $30,000 under the Tripartite Mediation Framework which covers issues such as:

Employment statutory benefits

Re-employment issues

Breach of employment contract

Payment of retrenchment benefits

Wrongful dismissal issues
